4.2. Restrictions
- You may not reproduce, copy, modify, distribute, sell, sublicense, or exploit any site content (commercially or otherwise) without prior written authorization from the creator (Jan Klever).
- You may not alter trademarks, captions, credits, or any other authorship information.
- You may not upload malware, viruses, or any malicious code in comments or form submissions.
- You may not engage in harassment, discrimination, racism, homophobia, hate speech, or any conduct that violates human rights or applicable law.
5. User/Contributor Conduct
- Comments, suggestions, and bibliographic submissions must be respectful, on-topic regarding literature, and free of offensive content.
- Comments that infringe copyright, contain defamation, hate speech, or violate legal norms will be removed without prior notice.
- The site reserves the right to moderate, edit, or refuse to publish any comment or suggestion that violates these Terms.
- By submitting information (text, images, links), the user guarantees they hold the copyright or have authorization to share it. In case of third-party claims, the user will be solely responsible.
6. Intellectual Property
- Original Site Content: All text, layout, design, images, and videos created or acquired for the site are the property of A Literatura Brasileira or third parties that grant usage rights. - User Submissions: By submitting book suggestions, reviews, or comments, the user represents that they hold the relevant copyrights or have permission to share the content, granting the site a non-exclusive license to display, edit, and promote the submission within the platform.
7. Disclaimer of Liability
- Accuracy of Information: We strive to provide accurate, up-to-date information about literary works and authors. However, we do not guarantee complete accuracy, as details may change (e.g., commercial prices, book availability).
- External Links: The site may contain hyperlinks to publisher websites, bookstores, or other external sources. We are not responsible for the content, navigation policies, or privacy practices of those sites. The inclusion of a link does not imply endorsement by A Literatura Brasileira.
- Technical Failures: The creator and operators are not liable for service interruptions, server failures, cyberattacks, or any events that temporarily render the site unavailable.
8. Changes to the Terms
We reserve the right to modify, in whole or in part, these Terms and Conditions at any time. Such changes will take effect immediately upon publication on the site. Users should periodically review these Terms to stay informed. Continued use of the site after modifications constitutes acceptance of the new Terms.
9. Applicable Law and Jurisdiction
- These Terms are governed by Brazilian law, especially the Civil Code (Law 10,406/2002), the Copyright Law (Law 9,610/1998), and other applicable digital regulations.
- To resolve any disputes arising from these Terms, the courts of the District of São Paulo (SP) are chosen as the exclusive forum, waiving any other forum, no matter how privileged.
10. Final Provisions
- If any clause of these Terms is deemed invalid or unenforceable, the remaining clauses will remain in full force and effect.
- Failure by the site to enforce any provision of these Terms does not constitute a waiver of that right.
- These Terms do not create any corporate, associative, employment, or joint liability relationship between the site and its users.
